Acceptance of Terms

  • By accessing or using Bharat Parking services, you agree to be bound by these Terms of Service
  • If you do not agree to these terms, you must not use our services
  • These terms apply to all users: individuals, corporate clients, facility managers, and visitors
  • Entering a parking facility equipped with our system constitutes acceptance of these terms
  • You must be at least 18 years old to use our services independently

Service Description

  • Automated vehicle entry and exit management
  • AI-powered number plate recognition
  • Digital payment processing
  • Parking duration tracking and billing
  • Mobile app for booking and management
  • Customer support services
  • Services are provided 'as is' and 'as available'
  • We aim for 99.9% uptime but cannot guarantee uninterrupted service
  • Maintenance windows may cause temporary service interruptions
  • Third-party services (payment gateways) may affect availability

User Accounts

  • You must provide accurate and complete information
  • One person or entity per account
  • You are responsible for maintaining account security
  • Notify us immediately of any unauthorized access
  • You must be legally capable of entering into contracts
  • Keep your login credentials confidential
  • Do not share your account with others
  • Update your information when it changes
  • You are liable for all activities under your account
  • Corporate accounts must designate authorized users
  • You may close your account at any time
  • We may suspend or terminate accounts for violations
  • Unpaid fees must be settled before account closure
  • We reserve the right to refuse service to anyone

Parking Rules & Conduct

  • Follow all posted parking facility rules and signage
  • Park only in designated areas
  • Do not block entry/exit points or emergency routes
  • Adhere to speed limits and safety protocols within premises
  • Remove your vehicle by the specified time limit
  • Respect other users' parking spaces
  • Leaving unattended or abandoned vehicles
  • Storing hazardous materials in vehicles
  • Commercial activities within parking premises
  • Tampering with parking equipment or cameras
  • Using parking facilities for purposes other than parking
  • Harassing staff or other users
  • Each parking facility may have additional rules
  • You are responsible for knowing facility-specific requirements
  • Violations may result in fines, towing, or legal action
  • Emergency vehicles always have priority access

Fees & Payments

  • Parking fees are displayed at facility entrances and in the app
  • Prices may vary by location, time, and duration
  • Dynamic pricing may apply during peak hours or events
  • All fees are in Indian Rupees (INR) unless stated otherwise
  • You will receive receipts for all transactions
  • We accept UPI, credit/debit cards, wallets, and net banking
  • Payment is processed through our partner JustMoney Pay
  • You authorize charges for parking services used
  • Failed payments may result in denied exit until settled
  • Subscription plans are billed automatically on renewal dates
  • Refunds are processed within 7-10 business days
  • Parking fees are non-refundable once services are used
  • Disputed charges must be reported within 30 days
  • We will investigate and respond to disputes within 15 days
  • Subscription cancellations take effect at end of billing period
  • Overstaying beyond booked time may incur additional charges
  • Lost tickets or payment issues may result in maximum daily rate
  • Repeated violations may lead to account suspension
  • Unpaid fees may be sent to collections

Liability & Disclaimers

  • We are not responsible for theft, damage, or loss of vehicles or contents
  • Park at your own risk - secure your vehicle properly
  • We are not liable for acts of nature, accidents, or third-party actions
  • Our liability is limited to parking service fees paid
  • We do not insure vehicles - maintain your own insurance
  • You are responsible for your vehicle and its contents
  • Report damage or issues immediately to facility management
  • Maintain valid vehicle insurance as required by law
  • You are liable for any damage you cause to facilities or other vehicles
  • Follow all traffic laws and facility safety protocols
  • We are not liable for failures due to circumstances beyond our control
  • This includes natural disasters, power outages, strikes, or government actions
  • Services may be suspended during emergencies without refund

Intellectual Property

  • All content, software, and technology are owned by Bharat Parking
  • Our name, logo, and branding are protected trademarks
  • You may not copy, modify, or distribute our proprietary materials
  • Camera footage and data remain our property
  • You grant us license to use vehicle images for service provision
  • Any feedback you provide may be used to improve our services

Privacy & Data Use

  • Your use of services is subject to our Privacy Policy
  • We collect vehicle and payment data as described in Privacy Policy
  • Camera footage is retained for security purposes
  • We may share data with facility owners and law enforcement when required
  • You consent to data processing necessary for service delivery

Changes to Terms & Services

  • We may update these terms at any time
  • Material changes will be notified via email or app notification
  • Continued use after changes constitutes acceptance
  • Changes take effect 30 days after notification
  • We will update the 'Last Updated' date at the top
  • We may add, modify, or discontinue features
  • Pricing and policies may change with notice
  • New features may have additional terms
  • We are not liable for modifications or discontinuation

Termination & Suspension

  • Violate these terms or facility rules
  • Engage in fraudulent activities
  • Fail to pay fees or have repeated payment failures
  • Use services for illegal purposes
  • Abuse staff or other users
  • Provide false information
  • Access to services and account will be revoked
  • Outstanding fees must be paid immediately
  • Subscriptions are cancelled without refund
  • You must remove vehicles from our facilities
  • We may ban you from future use of services

Dispute Resolution

  • First, contact our customer support to resolve issues
  • If unresolved, disputes will be subject to arbitration
  • Arbitration will be conducted in Indore, Madhya Pradesh
  • You agree to binding arbitration for all disputes
  • Class action lawsuits are waived
  • These terms are governed by Indian law
  • Courts of Indore, Madhya Pradesh have exclusive jurisdiction
  • If any provision is invalid, remaining terms remain in effect
  • Our failure to enforce any right does not waive that right

Miscellaneous

  • These terms constitute the entire agreement between you and Bharat Parking
  • You may not transfer your account or rights under these terms
  • We may assign our rights and obligations to affiliates or successors
  • Headings are for convenience only and do not affect interpretation

  • Printed receipts and digital records are valid proof of transactions

Important Legal Notice

By using Bharat Parking services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must discontinue use immediately.

DISCLAIMER: We are not responsible for vehicle theft, damage, or loss. You park at your own risk. Maintain proper insurance and secure your vehicle.
